2. Introduction

These Terms and Conditions establish the rules and regulations for the provision of boat tour services by Prestigeo in Portugal. By booking or participating in a boat tour with Prestigeo, the client accepts all the terms and conditions presented herein.

2.1. By validating a booking request, the user must follow the online purchase procedure and click on "Complete Payment," after reading and accepting these Purchase Conditions. At this point, they will be entering into a Contract of Sale with us (the "Contract"). Upon doing so, they will receive an email confirming receipt of their request (the "Order Confirmation").

Subsequently, the user will be informed via an email confirmation of the booking after payment confirmation.

2.2. For the purposes of these Terms and Conditions, the following definitions apply:

"Experiences" - The services marketed on the website prestigeo.pt.

"User" - Any natural person, non-trader, who places an order through the website prestigeo.pt.

2.3. The use of the website prestigeo.pt and the purchase of products imply the user's knowledge, understanding, and acceptance of these Terms and Conditions.

2.4. Experiences

A) Description of Experiences:
The images and descriptions of the experiences available on the site are presented as accurately as possible to depict the service offered. However, due to the nature of boat tour experiences and outdoor activities, slight variations may occur concerning what is shown in the images or described on the site. Scenarios, weather conditions, and other natural factors may influence the real experience. Prestigeo is committed to providing high-quality experiences but cannot guarantee that all elements depicted in the images, such as weather conditions or specific landscapes, will be present on the day of the tour.

B) Features of Experiences:
The characteristics of each experience, including duration, itinerary, included activities, and maximum passenger capacity, are detailed on the site. However, users should consider that weather conditions, maritime conditions, and other unforeseen factors may require adjustments to the itinerary or duration of the experience. We recommend that clients carefully read the description of each experience to familiarize themselves with the details and possible variations. The photographs serve to illustrate the nature of the experience but do not guarantee an exact representation of what will occur on each tour.

2.5. Service Description

a) Offered Experiences: Prestigeo offers boat tours in Tróia, Arrábida, and Sesimbra, with options that include gastronomic experiences, water activities, and leisure moments. The tours are adapted for groups, families, and private events, with customizable itineraries according to clients' preferences.

b) Itinerary and Duration: Tours may vary in duration and itinerary, as detailed at the time of booking. Clients will be informed about the route, expected duration, and included activities such as diving, snorkeling, or onboard gastronomic experiences.

Bookings and Payments

3.1. Making a Booking

Bookings can be made online, from anywhere, 24 hours a day, 7 days a week.

Booking confirmation is subject to availability and acceptance of these Terms and Conditions.

3.2. Booking Process on the Website
To make a booking on the website, follow these steps:

Selection of Experience: Browse the site and select the desired experience or boat tour. Add it to the booking cart, indicating the desired date and time.

Booking Confirmation: Once the experience is selected, it will be added to your booking cart. The next step is to process the order and make the payment. During the booking process, the user must fill in or confirm the necessary information, such as name, email, number of participants, and any additional requirements.

Modification of the Booking: Before finalizing the booking and proceeding with payment, the user may modify its details at any time.

Registration on the Website: The user can create an account on prestigeo.pt to access and update personal details, check booking status, and access the history of previous bookings.

Data Entry: Fill in all mandatory fields in the booking form and select the desired payment method.

Acceptance of Terms: Read and accept the Terms and Conditions and Privacy Policy of the site by ticking the corresponding box.

Finalizing the Booking: After confirmation, a screen will appear with the booking details, which can be printed for reference. The user will also receive an automatic email confirmation with the booking details and payment information.

Email Confirmation: After completing the booking, the user will receive a confirmation email with all details, including date, time, meeting location, and additional instructions.

By making a booking, the user accepts the General Terms and Conditions of Sale on the site, as well as the Privacy and Data Protection Policies.

3.3. Guest Booking

The guest booking functionality is also available on our website.

By choosing this mode, only the essential data required to process the booking will be requested.

After completing the booking, the user will have the option to register on the site or continue as a guest.

3.4. Changes to the Offer of Experiences

Prestigeo reserves the right to modify, at any time, the offer of experiences, prices, promotions, and conditions presented on the website prestigeo.pt.

Changes will not affect already confirmed bookings.

3.5. Availability of Experiences

Prestigeo will honour bookings made online up to the limit of available experiences.

If a booked experience is unavailable, Prestigeo commits to informing the user as soon as possible and proposing an alternative solution, such as rescheduling or a full refund.

3.6. Billing Data

The data provided for billing is the user's responsibility.

Once issued, the invoice cannot be reissued with alterations.

3.7. Booking Confirmation

Bookings are only confirmed after payment.

If payment is not received within 48 hours, the booking will be canceled.

3.8. Cancellation and Booking Refusal

Prestigeo reserves the right not to accept or cancel already confirmed bookings in the following situations:

The experience is not available on the selected date or time.

Payment was not made through the available payment methods.

Payment was not confirmed within 48 hours of booking.

The provided billing information is incorrect or unverifiable.

There is an error in the price quote.

It is not possible to meet the logistical requirements of the booking.

3.9. Payment and Confirmation

To confirm the booking, full payment is required.

Accepted payment methods: Credit Card, Multibanco Reference, MBWay, Pay Shop, Apple Pay, Credit/Debit Card processed through If Then Pay. Payments via Multibanco Reference have a deadline of up to 60 minutes to guarantee the tour reservation.

If payment is not received within the specified time frame, the booking will not be validated. Any payment received after this period will be refunded or may be used for a new booking upon written request by the client.

4. Cancellations, Changes, and Refunds

4.1. Cancellations by the Client

Cancellations made more than 15 days in advance entitle the client to a full refund of the deposit.

Cancellations made less than 15 days in advance are non-refundable.

4.2. Cancellations by Prestigeo

Prestigeo reserves the right to cancel a tour due to adverse weather conditions or unforeseen factors.

In such cases, the client will be entitled to a full refund or a rescheduling of the tour to an available date.

4.3. Date Changes

Clients may request a change of tour date at least 7 days in advance, subject to availability and possible rescheduling fees.

4.4. Withdrawal During the Tour

If a client chooses to interrupt the tour after it has started, no partial refund will be issued.

4.5. No-Show and Delays

In case of no-show or a delay exceeding 30 minutes, Prestigeo reserves the right to begin the tour without the client, with no refund granted.

5. Safety and Conduct Onboard

5.1. Safety Equipment

Prestigeo provides all necessary safety equipment, including life jackets.

All passengers must follow the crew’s instructions at all times and use safety equipment as required.

5.2. Boat Capacity

The maximum boat capacity will be informed at the time of booking.

Prestigeo reserves the right to refuse entry to passengers exceeding the boat’s capacity limit.

5.3. Onboard Conduct

Smoking is prohibited onboard.

The consumption of alcoholic beverages is allowed only in designated areas and must be done in moderation.

Prestigeo reserves the right to refuse participation to any passenger displaying reckless behaviour or endangering the safety of others.

5.4. Prohibited Items

The following are not allowed onboard:

Illegal substances.

Dangerous objects.

Pets (unless previously authorized by Prestigeo).

6. Liability and Insurance

6.1. Insurance

Prestigeo holds civil liability insurance that covers accidents occurring during the tour.

Clients are recommended to obtain travel insurance that includes nautical activities.

6.2. Liability Limitations

Prestigeo is not responsible for accidents caused by reckless or negligent behaviour of passengers.

Prestigeo is not liable for damage or loss of personal belongings during the tour.

6.3. Damage to the Boat

Clients will be held responsible for any damage caused to the boat or equipment due to reckless or negligent behaviour.

7. Weather Conditions and Tour Impact

7.1. Weather and Cancellations

Weather conditions may affect tour operations.

Prestigeo reserves the right to cancel or alter the tour route for safety reasons.

7.2. Options for Weather-Related Cancellations

In case of cancellation due to adverse weather conditions, clients may choose between rescheduling for another available date or receiving a full refund.

8. Privacy Policy

8.1. Data Protection

Prestigeo is committed to protecting client data in compliance with the General Data Protection Regulation (GDPR).

Data collected is used solely for managing bookings and client communication.

8.2. Data Storage and Use

Personal data is stored securely and will not be shared with third parties without the client’s consent, except when required by law.

9. Website Terms of Use

9.1. Website Use

The use of Prestigeo’s website is subject to its Terms of Use and Privacy Policy.

11. Sales and Shipping Policy

All transactions are carried out in euros (€) and include applicable taxes.

11.2. Product Shipping and Delivery

If physical products (such as vouchers or souvenirs) are sold, Prestigeo will ship them to the address provided by the client, subject to applicable shipping costs and delivery timeframes.

12. Photography and Filming

Prestigeo may take photos and record videos during tours for promotional purposes.

By participating in a tour, clients authorize Prestigeo to use these images for marketing purposes, unless otherwise stated before the tour begins.

13. Clean & Safe Certification

13.1. Health and Safety Measures

Prestigeo complies with the “Clean & Safe” standards set by Turismo de Portugal, ensuring health and safety measures to protect passengers.

14. Complaints and Warranty

14.1. Complaints

Complaints must be submitted in writing within 5 days of the tour date.

Prestigeo commits to responding to complaints within 15 working days.

14.2. Warranty and After-Sales Service

Prestigeo strives to provide high-quality services but cannot guarantee client satisfaction regarding external factors such as weather conditions.

15. Catering and Beverages Policy

15.1. Catering Service

If catering services or gastronomic experiences are included in the booking, specific details and terms will be agreed upon at the time of booking.

Alcohol consumption must be moderate and limited to designated areas.

16. Pets Policy

16.1. Pets Onboard

Pets are only allowed onboard with prior authorization from Prestigeo.

Pets must remain in designated areas.

17. Available Languages

17.1. Language Options

Tours are conducted in Portuguese and English.

Additional language options may be available upon prior request.

18. Notices and Liability Exemptions

18.1. Force Majeure

Prestigeo is not responsible for delays or cancellations due to force majeure events such as natural disasters, pandemics, or government restrictions.

Changes to the Terms and Conditions

19.1. Right to Modify:
Prestigeo reserves the right to amend these Terms and Conditions at any time.
Any changes will be published on the website and will take effect immediately upon publication.

22.1. Acceptance:
By booking or participating in a boat tour with Prestigeo, the client declares that they have read, understood, and agreed to all the terms and conditions set forth herein.

Legal Provisions and Regulations

Prestigeo is governed by the applicable Portuguese legislation for maritime tourism and the European consumer protection regulations. Therefore, in addition to the previously stated Terms and Conditions, the following legal and regulatory provisions also apply:

23.1. Compliance with Tourism Law in Portugal

Prestigeo operates in accordance with the applicable Portuguese legislation on maritime tourism, specifically Decree-Law No. 108/2009 and Decree-Law No. 186/2015. The company also complies with safety standards imposed by the Institute for Mobility and Transport (IMT) and the Directorate-General for Natural Resources, Safety, and Maritime Services (DGRM).

23.2. Right of Withdrawal and Exclusions

According to Decree-Law No. 24/2014, Article 17, paragraph j), the 14-day right of withdrawal does not apply to leisure services with a defined date. Therefore, once the booking is confirmed, the client will not be able to request a refund, except for exceptions provided in these Terms and Conditions.

23.3. Civil Liability and Insurance

Prestigeo holds civil liability insurance as required by Portuguese law. However, it is recommended that clients have adequate travel insurance that covers potential incidents during the nautical activity.

23.4. Electronic Complaints Book

23.5. Data Protection and GDPR

Prestigeo processes clients’ personal data in accordance with the General Data Protection Regulation (GDPR - EU Regulation 2016/679). Clients have the right to:

23.6. Force Majeure

Prestigeo is not liable for cancellations or service changes due to force majeure, including:

Adverse weather conditions.

Government restrictions.

Strikes or unexpected technical failures.

23.7. Health and Physical Condition of Passengers

By booking a tour, the client declares that they are physically fit to participate in the experience and assume full responsibility for their health and safety. Prestigeo is not responsible for medical complications resulting from participation in the activity.
